2. Services
Empowered Mind and Body LLC is a nurse practitioner-led health and wellness practice that may offer services including, but not limited to:
* Preventive care
* Wellness consultations
* Lifestyle and health coaching
* Aesthetic or functional medicine services
All services are subject to availability and may require completion of intake forms, consent documents, and eligibility screening.
3. Eligibility
You must be at least 18 years old to use this Site or schedule services unless accompanied by a parent or legal guardian.
4. User Responsibilities
By using this Site, you agree to:
* Provide accurate and truthful information
* Use the Site only for lawful purposes
* Not attempt to gain unauthorized access to any portion of the Site
5. Appointments and Payments
Appointments may be scheduled through the Site or via third-party platforms. Cancellation and no-show policies will be disclosed at the time of booking.
Payment terms, including fees for services, are provided prior to service delivery. You agree to pay all applicable fees.
5A. Memberships and Subscription Plans
If offered, membership or subscription plans are subject to the following terms:
**Automatic Renewal:** Memberships automatically renew at the stated billing interval (e.g., monthly) unless canceled in accordance with this section.
**Payment Authorization:** By enrolling in a Membership, you authorize Empowered Mind and Body LLC to charge your designated payment method on a recurring basis for all applicable fees, taxes, and add-on services.
**No Insurance Billing:** Membership fees are generally not billable to insurance unless explicitly stated. You are responsible for understanding what services may or may not be eligible for reimbursement.
**Included Services:** Membership benefits, including included services, discounts, or credits, are defined at the time of enrollment and are subject to change with notice as permitted by law.
**Unused Benefits:** Unless otherwise stated, unused monthly services, credits, or benefits do not roll over and have no cash value.
**Cancellations:** You may cancel your Membership at any time by providing at least 30 days written notice prior to your next billing date. Cancellations will take effect at the end of the current billing cycle. No prorated refunds will be issued unless required by law.
**Refunds:** Membership fees are non-refundable once billed, except where required under Minnesota law.
**Suspension or Termination:** We reserve the right to suspend or terminate Memberships for non-payment, misuse of services, or violation of these Terms.
**Price Changes:** We may modify Membership pricing or benefits with advance notice. Continued use after such changes constitutes acceptance.
6. Telehealth
If telehealth services are offered, they are provided in accordance with Minnesota telehealth laws and regulations. By using telehealth services, you acknowledge and agree that:
* Telehealth services may be conducted via secure, HIPAA-compliant electronic communications
* A provider–patient relationship may be established only after appropriate identity verification, consent, and clinical appropriateness determination
* You must be physically located in the State of Minnesota at the time of the telehealth visit unless otherwise permitted by law
* You understand the limitations and potential risks of telehealth, including technology failures and limitations in physical examination
* You are responsible for ensuring a private, secure environment during sessions
7. Privacy
Your use of this Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
8. Intellectual Property
All content on this Site, including text, graphics, logos, and images, is the property of Empowered Mind and Body LLC and is protected by intellectual property laws. You may not reproduce, distribute, or exploit any content without prior written permission.

15. HIPAA and Minnesota Health Records Compliance
This practice complies with the Health Insurance Portability and Accountability Act (HIPAA), as well as applicable Minnesota health records laws, including but not limited to the Minnesota Health Records Act (Minn. Stat. § 144.291–144.298).
Protected health information (PHI) is collected, used, and disclosed only as permitted by federal and Minnesota law. Patients have rights regarding access to and control of their medical records as outlined in our Notice of Privacy Practices.
16. Scope of Practice
All clinical services are provided by licensed nurse practitioners and/or other qualified healthcare professionals practicing within the scope of their licensure under Minnesota law. Certain services may require physician collaboration or referral as required by applicable regulations.
17. Prescription and Treatment Policies
Any prescriptions, treatments, or recommendations provided are based on clinical judgment, applicable Minnesota laws, and standard of care. We reserve the right to decline or modify treatment plans if deemed medically inappropriate or non-compliant with regulatory requirements.
